Terms and Conditions for SHEIN Personalized Products
As used in these terms and conditions, " SHEIN ", the " Company ", " we", " us" and " our" shall refer to Fashion Choice Pte. Ltd. and its affiliates and " you" or " your" shall refer to the person or entity submitting images, designs, text or other content ("Content") to be incorporated into customized products on www.shein.com or purchasing such products. If you wish to purchase customized products on www.shein.com, you must accept these terms and conditions without changes.
BY CLICKING THE "CUSTOMIZE NOW" BUTTON OR PLACING YOUR ORDER FOR CUSTOMIZED PRODUCTS, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING, WITHOUT LIMITATION, THE PRIVACY POLICY OF SHEIN , THE SHEIN TERMS AND CONDITIONS AS AMENDED FROM TIME TO TIME.
  • 1. Content: you may submit your own content or select from a gallery of designs and images to create customized products. You may only submit Content that complies with the SHEIN TERMS AND CONDITIONS , which prohibit pornographic, slanderous, defamatory, libelous, obscene or objectionable content on racial, ethnic or other grounds and applicable laws (including intellectual property laws). We expressly reserve the right to reject any non-compliant material.
  • 2. License Grant for Your Content: you hereby grant SHEIN, its affiliates and sublicensees (including third parties providing customized products and related services) (collectively, the "Customization Providers") a worldwide, non-exclusive, royalty-free, perpetual, irrevocable and fully sublicensable right, in connection with the production and your purchase of customized products, to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute and display the Content you submit (including the names and likenesses of any persons appearing in the Content).
    Please note that we will use your Content solely for the purpose of providing services to you and fulfilling your orders for customized products. We will not use, sell or distribute your uploaded Content or any personal information for other unauthorized purposes.
  • 3. Representations, Warranties and Indemnities: you represent and warrant that you have the right to grant the licenses set forth in these terms and conditions; that the use of this Content by the Customization Providers will not violate, misappropriate or infringe any intellectual property rights or cause injury to any person or entity; and that you will defend, indemnify and hold harmless the Customization Providers from and against any losses, damages, judgments, settlements, expenses, interest and any other liabilities (including reasonable attorneys' fees and costs) related to or arising out of any third-party allegation, claim, demand or proceeding (a "Claim") to the extent such Claim is based on a breach of these terms and conditions;
  • 4. Resale Prohibition: it is prohibited to resell customized products, offer them for sale or make them available to any person, in any place, in whole or in part, directly or indirectly, through online or offline channels. The customization service is only for the purchase of products for use and you agree not to use the Service for commercial operations as a product supplier or for any business or commercial purpose, unless specifically authorized in writing by SHEIN. To avoid potential risks, you shall not order more than 10 customized products at a time. And violation of the resale prohibition may result in claims for monetary damages and legal liabilities against you.
  • 5. SHEIN Intellectual Property: you may not use SHEIN's intellectual property in any way without SHEIN's prior written consent. These terms and conditions and your purchase of customized products do not grant you any rights in such intellectual property (including photographs, illustrations, graphics, text, designs or images made available to you for customization).
  • 6. Returns: customized products CANNOT be returned or exchanged, only if we provide incorrect customized products (for example, your receipt of customized products with patterns that are not from your submission).
  • 7. Modifications: We may modify these terms and conditions in our sole discretion by posting the modified terms on the SHEIN.com website. Your continued purchase of customized products on SHEIN.com after the effective date of the modified terms constitutes your acceptance of the modified terms.
